Texas Dodge responded

We understand how confusing buying a new vehicle can be and I would like to be sure there is no misunderstanding. I have completely reviewed your complaint, and wanted to respond as quickly as possible to your concerns. It looks like the three biggest areas of concern are the price offered for our vehicle, the amount offered for your trade, and the interest rate on your loan. In reviewing the paperwork, the sales price that was offered on the car you were looking at was almost $2000 less than retail, and we are actually fixing the hail for about $500 per car. This type of light hail is easily repaired using paint-less dent repair (PDR) for a fraction of what hail repair used to cost. I am sure they would have been happy to schedule a repair on the car, and you would still come out $1500 under retail. Secondly, the value of your trade in was placed at $2500. I did not see the car, but it seems pretty fair for a 2002 Mercury Cougar with a manual transmission and over 100K miles. Full NADA trade in on that car is $2575, and that is before any reconditioning the car may need. It is possible that the confusion lies in the fact that there is still a payoff on your Mercury, and that payoff was for more than the $2500 we appraised the car for. We clearly were at fault for not properly explaining the fact that only the amount of the car’s appraised value that exceeds the payoff on the car will be applied as a reduction in the amount financed. Example: If a car is worth $3000, and the amount of payoff is also $3000, there is no positive or negative equity, and the amount of the loan will not increase or decrease. If a car is worth $3000 and there is no payoff, the amount you would borrow would be $3000 less, etc. In this case, we placed a $2500 valuation on a vehicle that had more than $2500 owed, so there is no decrease in the loan amount due to the trade. We don’t “get the car for free” in this instance because we are giving you $2500 for your trade AND we are cutting a check for $3000 to your lender. Lastly, the APR we were using for the loan were from your lender, as they looked like a reasonable APR based on the information that was provided to us. I do not believe we ever got to the point of “shopping” for the best rate, because we had not yet agreed on selling price, trade value, etc. We typically will not send someone’s credit information in for approval unless we feel confident we are close to a deal. At that time we will find the best rate for you based on your credit history. Although I feel confident that we were not dealing in any deceptive manner, I would like to apologize for our lack of communication that made you feel as though we were. I would be more than happy to set an appointment and go over all these details in person if that would help. Thanks, Darren Marcum General Manger Texas Dodge
