First, I want to say that Capitol Nissan does not engage in bait-and-switch practices or submit unauthorized financing. That is not how we conduct business, and we would never intentionally misrepresent the terms of a transaction. That said, I understand from your review that you feel the process was unclear and that the documentation you received did not align with your understanding of the deal. If there was any miscommunication or breakdown in process, that is something we absolutely want to review thoroughly. Because your comments involve specific contractual documents, credit inquiries, and title processing, it would be inappropriate to discuss those details in a public forum. However, we would welcome the opportunity to review the full deal file, timelines, and compliance documentation with you directly. Thank you for your response, including the follow-up from your General Sales Manager. To clarify, the concern is not about whether we visited Capitol Nissan, signed documents, or paid by check. Those facts are not in dispute. The issue is disclosure and authorization. In a follow-up message dated February 9 at 12:07 PM, it was explained that as “company policy” a credit application was run and a backup contract was prepared through TD Auto in case the personal check did not clear. A screenshot of that email has been preserved. At no point during the transaction on January 4, 2026 were we informed that: • A credit application would be submitted • Hard credit inquiries would occur • A financing application would be sent to TD Auto or any lender • A backup contract would be generated We explicitly declined financing multiple times and proceeded with a full cash purchase of $40,500.80. The check cleared on January 5, 2026. Separately, Capitol Nissan publicly stated on Google Maps that it “does not convert cash purchases into financed deals without customer authorization.” For transparency, we are documenting both the public statement and the internal explanation so the timeline and sequence of events are clear. Formal written requests for documentation and clarification were also sent on February 11 and February 12, 2026, requesting complete copies of all documents submitted to any lender and to the DMV, along with clarification regarding how and when authorization for credit submission was obtained. As of this writing, those specific documentation requests have not been substantively addressed in writing. If a credit application was signed, we request a complete copy of that document as executed, including timestamps, submission records, and confirmation of the exact date and time it was transmitted to TD Auto or any other entity. We are seeking written clarification regarding: • When disclosure of lender submission and credit inquiry was provided. • The basis for submitting a credit application after financing was declined. • The internal policy requiring credit submission for personal checks, and where that policy is disclosed to customers. • Confirmation that no lender account was opened and that no further credit activity will occur. • The current verified status of the title transfer, including the date it was submitted to the DMV and the expected delivery timeline. As of February 19, 2026, more than six weeks have passed since payment cleared and the title has not been received. Important note for consumers: The dealership appears on the Better Business Bureau website under the name “Capital Nissan.” Consumers searching for “Capitol Nissan San Jose” may wish to verify the listing carefully to ensure they are reviewing the correct business profile. We are not making conclusions — we are documenting events and requesting clarity. We remain willing to resolve this transparently and in writing.

Update (March 1, 2026): 55 days after full payment cleared, I still have not received the title, registration, or license plates. Experian removed the related hard inquiry after my dispute. I have sent more than 10 written requests for documentation; only one response was received, stating it is “company policy” to run credit applications even for cash purchases. We were never informed that a credit application or hard inquiries would be required. We continue to request written clarification.
