Dear Brett I have felt bad as to how things went down ever since you and your family left our dealership the other day. When I came out at the end I had just received some disturbing personal news and with your wife raising her voice on the showroom floor I wasn’t prepared to offer any other solutions to a situation where in my opinion we had done nothing wrong so I probably overreacted. As I showed you at our meeting you and your wife were presented with a Carfax vehicle history report on the vehicle at time of delivery. The first page of the report, at the very top of the page, clearly shows both the accident and the air bag deployment along with a yellow caution triangle next to them. Both you and your wife signed the first page as well as initialing every other page of the report. I understand your position is that no one told you the importance of the report but the fact that you were asked to initial every page indicates that it wasn’t just a rushed through, sign here type of document. So I think it’s obvious we did not try to hide anything and attempted to make you well aware of the vehicles previous damage. In reviewing the paperwork from when you purchased the car, it appears you financed the sales tax along with the price of the car and did not put any money down. Given this scenario it would be very difficult to not owe more on the vehicle than its current market value after only making ten payments. The other dealers you spoke with, I am quite sure agreed to pay off the car but not truly give you the payoff as the value. The current value of your Civic is less about a previous accident and more about current market conditions. A quick check on websites such as Kelley Blue Book (kbb.com), Edmunds.com, NADA.com and many others indicate that the average trade-in value of a 2009 Honda Civic hybrid with 52,000 miles in this area ranges from about $8,600 to $9,600. That fact that the vehicle has been in an accident does affect the value but certainly not by 50%. When we met you indicated that what you were really trying to accomplish was to get onto a larger vehicle and shorten the term of your payments. You also indicate that the payment wasn’t as important the term. The two vehicles I suggested I felt were similar to the two you were shown at other dealers. In both cases we offered to discount the vehicles from an already competitively market price and in an effort to keep you as a happy customer give you $12,000 for your current car, which, as shown above, is over market value. Unfortunately, we were unable to meet the strict payment budget plus the shorter term your wife was wanting. I can’t tell how much I hate having an upset customer. I will actually lose sleep over situations like this, especially when I feel we have done everything in an upfront and honest manor. While I still don’t believe we did anything incorrectly, I would offer you this solution. I would still be willing to buy the car from you. By your own admission the Civic has been a good car for you. You have driven it for 12,000 miles and it is a year older then when you purchased it. Unfortunately, given the original loan information above I would not be able to pay you enough to satisfy your current payoff amount. I would be willing, as a good will gesture, to pay you $12,000 which is significantly above the current market value. This would necessitate you coming up with the funds necessary to make up the difference of the payoff so we could obtain a clear title to the vehicle. This offer will be available for the next ten business days. Please let me know at your earliest convenience if you would like to proceed. John Ellena
