The manager signed a written agreement on my deal sheet stating I would receive the $4,000 rebate 'later'. However, because their finance department failed to properly submit the IRS Point of Sale Transfer, the rebate is completely inaccessible to a buyer without tax liability a trap they knew or should have known. General Manager Nestor Calderon has actively refused to honor the manager signed contract. A formal fraud complaint will be filed soon with the New Jersey Division of Consumer Affairs, and legal action for $12,000 in treble damages under NJ Consumer Law is underway. Avoid this dealership's predatory financing games.

First, regarding our advertising, Car Vision strictly complies with all regulatory and legal disclosure mandates. The online listing conspicuously displayed a bright green banner stating “Price Shown After IRS EV Tax Rebate (*)” directly over the vehicle image, ensuring the conditional nature of the net price was transparent from the very beginning. Furthermore, the accompanying disclaimer clearly directed customers to the official IRS guidelines, making it plain that the $4,000 credit is a federal tax benefit subject entirely to IRS eligibility criteria, not a dealership-issued discount or a guaranteed markdown. This understanding was explicitly reinforced at the time of purchase via the signed proposal, which prominently featured the handwritten notation that you would apply for the rebate later.
Second, regarding the administration of the credit, our team has acted with total transparency and went above and beyond to provide assistance. Our General Manager, Nestor Calderon, was actively engaged in guiding you, even providing direct assistance over the phone to clarify the parameters of the program. However, the IRS Clean Vehicle program has strict regulatory guidelines and specific required parameters that must be established to execute a time-of-sale report.
Because the required consumer-side eligibility criteria and program parameters were not met, a time-of-sale report could not be successfully registered through the portal.
Our dealership has fully met its compliance and advertising obligations and stood completely ready to assist. Ultimately, the inability to claim the credit is due to the fact that the strict eligibility rules established by the federal program were not met on the consumer side.

You explicitly admit that the agreement features the signed notation that the buyer would apply for the rebate later. However, under strict IRS frameworks, it is legally impossible for an individual consumer to apply for a used EV rebate independently later unless the dealership first initiates a "Point of Sale Transfer" via the IRS Energy Credits Online portal. Your General Sales Manager, Keith Penny, gave false compliance advice to secure a $25,005 sale, assuring me I could do this on my own. By countersigning that contract provision, your management legally bound itself to a premise built on deception.
You claim consumer-side parameters were not met. This is entirely contradicted by the formal documentation. The Vehicle Buyer's Order was executed strictly in my individual name, and the Bank of America Cashier's Check (No. 6311703205) explicitly lists me personally as the individual remitter. Your dealership willingly accepted, endorsed, and deposited that check, which carried a clear restrictive endorsement memo reinforcing that the transaction excluded the rebate. You had all necessary consumer parameters; your staff simply failed to execute the mandated federal paperwork.
