Full Cash Transaction — Undisclosed Credit Inquiries and Ongoing Title Delay This review concerns Capitol Nissan–Infiniti (San Jose), which appears to operate as a single dealership group. Transaction D Ongoing Title Delay This review concerns Capitol Nissan–Infiniti (San Jose), which appears to operate as a single dealership group. Transaction Date: January 4, 2026 Vehicle: 2021 BMW 430i Payment: $40,500.80 (full cash, personal check) Summary of Issues Credit application submitted without disclosure or authorization 14 credit inquiries recorded (partial removals confirmed) Financed contract documents generated despite cash purchase Contract reflects ~6.84% APR and total of payments near $48,000+ Most documents lacking dealer signatures Title, registration, and license plates not received after 73 days 12 written requests sent; only one response received Repeated attempts to shift communication away from written records Two separate REG 262 documents executed without explanation REG 262 (both versions) lacking dealer signatures Details As of March 19, 2026, 73 days have passed since payment cleared, and the vehicle title, registration, and plates have not been delivered. The temporary registration expires April 4, 2026, yet the title transfer remains incomplete. We declined financing multiple times. Nevertheless, a credit application was submitted and multiple credit inquiries were generated without prior disclosure or documented authorization. Our credit reports show 14 inquiries associated with this transaction. Experian has already removed several inquiries following the dispute, and a lender confirmed in writing that a related inquiry was submitted for removal after an internal investigation. In a written email dated February 9, 2026, General Sales Manager Eric Lam stated that: credit checks and backup finance contracts are performed as “company policy” for cash transactions in case a personal check does not clear. Despite this, we were never informed that a credit application would be submitted. The day after the transaction, and after the personal check had already cleared, we received documents by email including a Retail Installment Sales Contract reflecting financing terms, including interest and assignment to TD Bank, despite this being a full cash purchase. Notably: Seller signature fields appear incomplete or marked only with “X” The contract references assignment to TD Bank, N.A. Two separate REG 262 documents were executed without explanation Both REG 262 documents appear to lack dealer signatures Taken together, these inconsistencies raise concerns regarding the accuracy, authorization, and execution of both financing and DMV documentation. Despite sending 12 written requests, the dealership has provided only one substantive response and has repeatedly attempted to move communication to phone or in-person discussions. Outstanding Requests Date of submission of title transfer to the California DMV Identification of authorization used to obtain credit reports As of March 19, 2026, this matter remains unresolved. We remain willing to resolve this matter transparently and in writing. For transparency, supporting documentation and screenshots have been uploaded to our Google Maps review. More
