I purchased a 2026 Mercedes-Benz, submitted payment, and signed the buyer’s order and retail purchase agreement in good faith. I reside in a different state, making this an interstate consumer transaction that legally requires transparency, delivery, and good-faith performance. After payment was tendered and the contract executed, the dealership failed to deliver the vehicle and then ceased all communication. No delivery. No explanation. No refund. No response. A primary contributor to this failure was Yvette in Finance, who was directly involved in the transaction. Once the paperwork was signed and payment submitted, she became completely unresponsive, along with the rest of the dealership. Calls, emails, and follow-ups were ignored. This conduct is not merely unprofessional—it implicates multiple consumer-protection violations. Based on the facts, this dealership’s actions appear to violate: Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Fla. Stat. § 501.201 et seq. Failing to deliver goods after accepting payment and executing a contract constitutes unfair and deceptive trade conduct. Uniform Commercial Code (UCC) Articles 2 and 9, as adopted in Florida A seller who accepts consideration but fails to deliver goods breaches fundamental obligations of sale and performance. Interstate commerce consumer protections Taking payment from an out-of-state buyer and then refusing communication or delivery raises serious interstate consumer-rights concerns. Implied covenant of good faith and fair dealing, recognized under Florida contract law Going silent after execution and payment is a clear failure of good-faith performance. To be absolutely clear: I live out of state Payment was submitted The buyer’s order was signed The retail agreement was executed The vehicle was never delivered Finance management, including Yvette, failed to communicate or perform Once they had my signature and payment, I was treated as if I no longer existed. This is not a delivery delay. This is non-performance after payment and contract execution. Mercedes-Benz markets itself on trust, integrity, and precision engineering. What this dealership delivered instead was: Silence after taking payment Avoidance after execution Disregard for basic consumer rights Indifference to interstate buyer protections If you are considering purchasing a vehicle from this dealership—especially if you live out of state—be warned: based on my experience, once they have your paperwork and money, you may be left without answers or recourse through the dealership itself. This conduct reflects a serious breakdown in finance oversight, dealership management, and compliance with consumer-protection laws. Mercedes-Benz USA, AutoNation leadership, and regulatory authorities should review how this dealership handles executed contracts and out-of-state consumers.
