I will be filing lawsuit against Luther Brookdale Toyota has unlawfully retained and misused my personal and trust information without my consent. I entered into the dealership as a private consumer, intend has unlawfully retained and misused my personal and trust information without my consent. I entered into the dealership as a private consumer, intending to acquire a 2026 Toyota Sequoia and to securitize the transaction through my private trust. During the transaction, I lawfully provided my identifying information including my ssn etc to complete the trust based acquisition. I was given a signed buyer's order, which I properly endorsed and securitized also filed a UCC-1 financing statement to claim a security interest in the property. I then delivered all completed documents to Luther Brookdale Toyota's finance representative, along with verbal instructions on how to process the securitized documents. Shortly therefor, the sales manager, who claimed himself to be the finance director, Robert Trimble, informed me that they would no longer conduct business with me. He also refused to return my application in folder containing all of my private information. instead, he stated he would retain and "audit" my information for taxes purposes for 25 months using my information- an act I have recorded as evidence, also known as identity theft. This conduct constitutes unauthorized use of my private and trust data, in violation of 15 USC 6801-6809 (Gramm Leach Bliley Act), which requires financial institutions o protect consumers' nonpublic personal information. It also constitutes identity theft and deceptive practices under 15 USC 1681b (Fair Credit Reporting Act) and the Truth in Lending Act (15 USC 1601) which mandate clear disclosure and prohibit financial misuse or nondisclosure of terms. After this incident, contacted law enforcement and filed a police report for identity theft (Ref. No. 252941514) Immediately return the 2026 Toyota Sequoia (VIN: 7SVAAABA0TX073061) into my rightful possession, as I lawfully claimed and securitized the property through my trust. Cease and desist from and continued use, audit, or transmission of my personal and trust information to third parties. Provide compensation or settlement for the unauthorized use and mishandling of my private financial information. I request immediate review and remedy to correct these violations and restore my property, privacy, and consumer rights under federal law. Also I did not enjoy the enter action with the sales rep Nair Wallace. Very very very horrible service I had to tell one of the rep. not to ever contact me AT ALL. I did not receive full disclosure. I didn't feel secure or safe, I literally had an anxiety attack while him, it was very intimidating, I didn't feel like he had good listening skills. The service was horrible! There was no equal consideration throughout this whole contract. This is not end of it. More
