Thank you for the response. I’m willing to bring the vehicle in for inspection only under the condition that the diagnostic fee is waived, due to the written confirmation I received regarding warranty coverage. I’m not comfortable proceeding if I’m being asked to pay for a diagnosis on a vehicle that was confirmed in writing to be under a 3-month/3,000-mile warranty. Please confirm in writing that the dealership will waive the diagnostic fee if the issue is determined to be non-covered, or that the warranty will be honored regardless. Once I have that, I’ll be happy to schedule the inspection.

Destinee, per our recent conversation. I assure that there will not be a diagnostic fee to determine the cause of the issue. We also agreed that once a cause is established, we would have further discussion as to how we would proceed. I need you to bring the vehicle in on Monday or Tuesday in the morning. I am her both days from 8:30am. I look forward to seeing you then and finding a resolution.

Thank you for your response and for confirming in writing that there will be no diagnostic fee. I appreciate the clarification. However, I want to reiterate an important point for the record: while I did sign an “as-is” purchase agreement at the time of sale, I received a written text message from my salesperson after the sale confirming a 3-month/3,000-mile complimentary warranty. That written assurance — made by a representative of your dealership — created a legitimate expectation of warranty coverage. Regardless of how that communication is interpreted internally, written representations from dealership staff can override “as-is” disclaimers under consumer protection law, especially when they alter the buyer’s understanding of the terms after the transaction. Due to the inconsistent information provided, the dealership’s refusal to acknowledge the post-sale warranty confirmation, and the unprofessional behavior from your service department — including ending communication when I sought legal clarification — I do not feel comfortable returning the vehicle to your facility. I have already submitted formal complaints to the Colorado Motor Vehicle Dealer Board, the Colorado Attorney General’s Office, and the Federal Trade Commission. I will continue documenting all communication and developments related to this matter. I hope the dealership ultimately chooses to take accountability and resolve this in good faith.
