Roy, We dealt in good faith with you when you were here buying the vehicle. At the end of everything, you shook Dan's hand in agreement of the numbers and proceeded with the transaction and paperwork. You signed everything yourself, including the title paperwork on your vehicle. Yes, we didn't catch that your deceased wife was listed on the title. But on your part, you said you brought the paperwork regarding your wife but didn't offer it to anyone here. You were never under any pressure or duress to do anything you didn't want to do, and you seemed happy and satisfied throughout the delivery process and when you left. And then you get home and decided to trash our employees, including a new salesperson who was doing her very best in working with you. To her credit she got a more experienced salesperson to come and show you the technology until you were satisfied. You accused us of gouging you. You are accusing us of making too much profit when, as of this writing, we haven't even finished doing the service work and reconditioning process on the vehicle. We could not remove the cross bars, because the wrong caps to cover the holes were in the vehicle from Toyota. Had we left the holes exposed, rain water would have soaked the interior of your vehicle. We ordered the correct caps and had those shipped straight to your home. And yes, the owner did call you upset when you demanded a check be cut back to you in exchange for the paperwork necessary because of your deceased wife. Such demands can be construed as blackmail in a court of law. Keep in mind, you signed the Buyer Order, and Provision #9 does state "Purchaser warrants that the trade-in vehicle is his property free and clear of all liens and encumbrances except otherwise noted on the title and that he will deliver a certificate of title thereto promptly." The title clearly has an encumbrance, and you are not being cooperative at all in fulfilling your contractual obligations to the deal you agreed to and signed. We would prefer you fulfill your contractual obligation to this agreement and provide what we need to transfer the title out of your name. But if you continue to be uncooperative and demanding things that were never part of the agreement, then we will pursue all legal remedies available to us.
