Mr. Keisker entered into a written contract to purchase a vehicle. A non refundable partial payment deposit was disclosed on the contract and Mr. Keisker signed the contract. He was aware that the vehicle was held in his name. We hate that any customer would feel this way and strive to prevent this from happening. We did everything that was asked pertaining to the contract.

I did sign a piece of paper Airport Honda purports to be a legal contract; however, in the Tennessee Consumer Protection Act (TN47-18-5519) it states what an agreement/contract must contain. By Tennessee law, a contract must: 1. "Be dated and signed by the provider and the individual". 2. "Disclose the amount, or method of determining the amount, of all fees, individually itemized, to be paid by the individual". 3. That the individual may cancel the agreement as provided in TN47-18-5520". 4. "An agreement must provide that the individual has the right to terminate the agreement at any time, without penalty or obligation, by giving the provider written or electronic notice, in which event the provider will refund all unexpended money that the provider or its agent has received from or on behalf of the individual for the reduction or satisfaction of the individual's debt." Airport Honda's purported contract contained none of those necessary elements. If Airport Honda insists this contract is legal and complete, then they need to honor the contract and give me the described car at the total price clearly listed on the contract which by law includes ALL fees and taxes. They never contacted me when "my" car came in; however, they've received and sold several. They also need to compensate me for a rental car from the date they received the first car meeting the description of the one I ordered until they deliver my new car to me. To sum it up: 1. The salesperson did not tell us the deposit was non-refundable. 2. He lied to us by saying SSNs were required to purchase a car in TN. 3. He lied to us by stating a 15% upcharge from the MSRP was standard practice by dealerships because of a high demand for, and shortage of these cars. 4. His paperwork was incomplete and did not contain necessary element required by law. I requested three things from Airport Honda to resolve the issue: 1. Airport Honda acknowledge that my wife and I no longer had an agreement/contract with them. 2. The $3,000 deposit be returned. 3. Any hard copies of paperwork and electronic files containing our SSNs be destroyed. Since Airport Honda has refused to meet my requests and continues to maintain their contract is legal and binding, they need to honor their contract and repay me for a comparable rental car. I hope they hurry. The rental costs are piling up. Clearly, the contract did not meet the requirements of the Tennessee Consumer Protection Act and the retaining of my $3,000 deposit is not legal. The salesman didn't tell us the deposit was non-refundable and he knows we didn't think it was non-refundable because when I cancelled the agreement that was discussed. Airport Honda should do the right, and honest thing. They were out absolutely no money or services and they know it.
