Stuart, #1 "sold me a car with an accident". That's not true, you don't know that. CARFAX says "NO ACCIDENT REPORTED", all they say is that damage had been reported, they even say "not all damage come from an accident". That could be due to a million things.. There is NO EVIDENCE the car was actually in a motor vehicle crash. #2 "would not help me" . You came in and sat with your salesman and a manager who offered you to trade the car for a new one for the whole amount on trade. The numbers didn't work for you and you asked us to do more than that, we couldn't... You came back 3 times, we tried, we simply couldn't find a common ground, that doesn't mean we would not help. I can supply copy of CARFAX to anyone who asks.

#1 sold me a car with an accident - I too can provide the same carfax report which clearly states that on 10/21/2017 "Damage reported. Damage to Front" - I specifically asked if there was any damage to the vehicle. You said NO - you also did not provide me with the carfacx report. I received the report from a different dealer. There is clear evidence the car was repaired. A different VW dealer picked it up in 2 minutes before pulling the carfax report for me. #2 would not help. - Yes I came in to try and work everything out with you. You did NOT offer the whole trade amount on the car - you offered $4000 less than what I paid you for the car. How is that at all reasonable. I only had the car for 2 weeks when I found out all this information and tried contacting your managers for over a week without any response. I called and emailed numerous times. What about the fact that you stated it went trough your CPO inspection when in fact you only did it on the day that I picked up the car at 1pm - yet I had to bring the car back twice for the alignment. Had to have the sun roof gasket replaced, missing parts for the jack tool kit, get the radio replaced as it was not working correctly etc etc. The list goes on. All you had to do was admit fault and that you made a mistake. Take the car back and I would have bought another from you. How can you say "common ground" when you want to offer me so much less for the car I bought 2 weeks earlier and not work anything out at all. And then on top of it all tell me you are doing my a courtesy - any dealer would offer the same amount for that car. In fact car max offered me more than what you offered. Everyone knows what you guys did was wrong - you have so many negative reviews and also an F rating on Better Business Bureau (guess you are doing something right) - my mistake for not reading them before going to your dealership.

Gunther Volkswagen Delray Beach responded

Stuart, you have now posted the same complaint on half a dozen sites, every day for the past few days, we are having to respond to the same story over and over again. This is no longer about you seeking resolution, but rather to cyber bully us, and attempt to tarnish our reputation out of spite. Your sentence “about 2 weeks later, I found out by another VW dealer that the car had been in an accident”. That statement is a blatant lie. Whoever told you that must be clairvoyant. Carfax CLEARLY STATES NO ACCIDENT. Please see screenshot attached reflecting VIN# of your car. The CARFAX does state damage was at one point reported to the car, but there is absolutely NO evidence of a motor vehicle crash. Damage could be a million different reasons. Regardless of that, previous damage or even accident on a car does not disqualify a vehicle from being CPO. Stuart, you are misinformed, and simply do not know what you are talking about regarding guidelines of CPO vehicles. Regarding your several issues, the vehicle is under warranty and any issues deemed issues by the manufacturer will be fixed via the CPO warranty. If what you claim to be an issue isn’t getting repaired it is because it isn’t deemed an issue per manufacturer guidelines. Last, you didn’t express the desire to return the car until well over 30 days after the sale. By then “returning” a car IS NOT an option. We did, however, give you an option to trade the car you purchased for a brand new car, allowing you a full refund on the trade. You declined. Our new cars have programs allowing us to extend larger discount to make up for any loss of trade value, we could not accommodate such an offer on another used car. At this point, you’ve posted this same complaint on over half a dozen websites, your wish of “taking the car back” only happens if you trade it in on a new car. Otherwise, it can’t be done.

Aug 27, 2018 -

Stuart responded

Well let’s stick to the facts then instead of you trying to twist things around. I did not lie about anything. When I found out about the car from a different VW dealer I called your office right away. I spent every day for a week trying to get in touch with a manager. Sometimes I even called twice a day and every time I asked for a manager I got the same song and dance that they were with a client or were out of the office. I left messages every time. I was also told by your receptionist to send an email to Joe Gunther as she was not sure where he was – I sent the email and got a canned response which I replied to immediately – and of course there was no response from that. By this stage over a week had passed and I finally thought my only option was to get in touch with my sales guy (who obviously does not have the ability to make a decision on a return vehicle and would need to consult with a manager). I came in to your office and only then did you offer to buy back my car for what the trade in value was, NOT for what I paid for the car – so you now offer me $4000 less than what I paid and all I was trying to do was to just wipe the deal clean and buy another car from you. You tried to sell me on new/used cars or lease something to keep me in my budget, but in order to do so I would have to eat $4000. Carfax – as I posted before – the report clearly states “10/21/2017 "Damage reported. Damage to Front" – I will gladly provide anyone with that report which also has the VIN. The front bumper had been removed and re-painted – the bolts from inside the hood for the grille / radiator had been removed. This is not about cyberbullying. This is not about trying to tarnish your reputation – you guys did that yourselves – just read your other google reviews and the complaints with BBB. This is just about the fact that you guys messed up and all you had to do was apologize and rectify the situation. As for the CPO – I did not even get the CPO report from you. I had to go to VW direct and ask them to get it from you. The CPO report also clearly states that everything passed inspection!! – Well, part of the CPO inspection is to make sure that the car does not have any issues and just to name a few, these are included: 1. Vehicle does NOT pull and the alignment is correct – My car had to come back twice for alignment. 2. The sunroof seal is good – mine had to be replaced 3. Jack and toolkit – mine were missing parts 4. Radio working – mine had to be replaced 5. Chip in windscreen – I had to get that fixed under my insurance So, you claim that because the car is under warranty that it is OK to sell the car under these conditions and the consumer can just get it fixed? Lastly – I did express my desire to return the car and also stated that I would even purchase another vehicle from you – new or used. However, I was not prepared to take a $4000 hit on my car which I only had for less than a month. We can go back and forth on this all day long – I have proof of everything from Carfax report, CPO report and repairs that were done by other VW dealers. What amazes me is the fact that only now you guys are responding to my e-mails/reviews and yet when I tried calling your office or e-mailed Joe Gunther, no one responded. Funny how things work. You want to talk? You have my number.\

We tried to resolve this amicably Scott. You told me on my first phone call to you that you had nothing to do with this and that it was all our fault, and that you weren't going to do anything about it. You left me very little choice, I asked you to share your attorney's info so that we can ask them about the money, you also refused. I had to be the bad guy, yes, but we weren't talking about a few bucks here, you owed us $15,877.00, which your attorney paid us, without any help from you.

Mr Blatt, We understand your frustration and we apologize for the trouble you are going through but, you are directing your frustration to the wrong entity and that's why your issue isn't getting resolved. Your issue is that a payment was taken from you to pay your previous lease AFTER it was returned and you would like it reimbursed, we understand and we even agree with you. The problem is that you are asking us, Gunther VW, for resolution when we are not involved in collecting any payments to begin with. We are a privately owned and operated dealership, and we DID NOT take a payment from you. The bank that holds your loan did, Volkswagen Credit, Inc. You need to understand that Gunther VW is not Volkswagen Credit, Inc. Gunther VW does not collect payments. You authorized your bank to autopay Volkswagen Credit Inc. We understand how frustrating that can be and we wish we could help but Gunther VW is not affiliated with the bank, therefore we neither have the authority to reverse or reimburse this charge, not the ability to call the bank on your behalf. I can tell you that this specific situation has happened to others before you, and the charges were reversed promptly. You have to speak to the bank, Volkswagen Credit, Inc, and explain that your car was returned prior to the payment taken. You were given proof of that with your paperwork, and if you need, we can provide again. The number to VCI is 800-521-0171. We hate to respond to personal matters over public sites but we needed to clarify that your complaint isn't with us, nevertheless we are offering you our assistance. If you need help making the call, feel free to stop by in person and we will sit by your side and help resolve.

Disgruntled Rube responded

I have directed my frustrations in detailed correspondence to all parties involved. I have contacted VW of America as directed by VW Credit. The RCM will be contacting you. Update... I previously authorized VW Credit to speak with you as was requested by my sales rep at Gunther (VW Credit has noted 3 attempts to speak with your dealership). I'm not demanding anything. I have been respectfully requesting a refund of a lease overpayment that VW Credit claims repeatedly should be coming from your dealership and that you acknowledge is in fact owed to me. I was patient and kind for 3 + weeks wasting time on hold with both VW Credit and your dealership. It took public complaint to get a response from your dealership and it is still on me to interrupt my work day to travel an hour to your dealership? I believe RCM is a regional representative for VW of America, at least this was the phrase given to me by Cindy R. the VW of America representative. I would imagine they will be reaching out to you shortly. Curious, how exactly can the dealership arrange credit for the lease of the car without speaking with VW Credit on my behalf? Or pay off the residual? Gunther grounded the car nearly 2 weeks after the deal closed and one day after the payment was received by VW Credit. They clam this is therefore your responsibility to refund the overpayment. Again, given the runaround.

Jul 25, 2018 -

Gunther Volkswagen Delray Beach responded

Not sure what RCM stands for, and not quite sure why you called the manufacturer either. Your complaint is with whomever took your payment: VW Credit, Inc. You need to talk to Volkswagen Credit, no one else. As I mentioned earlier, come in and we'll help you get through to them if you're having trouble, but regarding your expectations you posted on another review site demanding us "doing it for you", Gunther CAN NOT speak to VCI on your behalf regarding your loan account, or your bank account, or your payments made, or anything involving your PRIVATE information. Surely you understand that there are privacy laws prohibiting the sharing of information over the phone. I wish we could because I guarantee you, one phone call and proper explanation to the bank will resolve this, but we can't do it without you, that's why I recommended you come in if you need help resolving this. If you want our help, it's available, come in. Otherwise I'm not sure what more we can do.

Jul 25, 2018 -

Gunther Volkswagen Delray Beach responded

If you choose to come in and get the help offered, bring ALL correspondence you have. I assume you have the names and contact info of people you spoke to at VCI credit, and Volkswagen of America.

Jul 26, 2018 -

Disgruntled Rube responded

Update to the Updated Update... VW Credit is performing service recovery and applying a credit to our account. Interesting that despite authorization from us to speak with Gunther, VW Credit's calls were never returned to address the issue.
