Dealer told us they parcipated in the CARS aka "Cash for Clunkers" program. We then negotiated and entered into a SIGNED contract (purchase agreement) with us 7/25/09 to purchase a new 2008 Lexux RX 400h. T Clunkers" program. The contract contained the price of the car, vin number, options included, our down payment and reference to the $4,500 credit our trade in vehicle was permitted. We obtained financing within three business days (because our intrest rate was far better than they could obtain) and told the dealer immediately on receipt on 7/29/09 that we had CASH to complete the transaction. They began ducking our calls on 7/31/09. We thought it very strange that they would turn away a customer with CASH IN HAND! They apparently didn't care if they didn't get our business. On 8/1/09, what may been the last day of the CARS program (for all we knew,) after we told the sales manager we were coming to get our car, they immediately called us back and told us they would NOT give us the car and accept our money unless they FIRST got their money from the govt. They had no idea when that could or woud occur. However, IF we agreed, they would release the car to us on 8/1/09, but ONLY if we agreed to deposit an ADDITIONAL $4,500 in proceeds (representing our govt. credit) which they could keep if they didn't get reimbursed. They told this they were taking this position with the four or five other customers that were participating in the CARS program as we were. We told them their conduct was dishonest and fraudulent and that they were in violation of our contract. No one made them participate in the CARS program. They simply could have told people it was a hassle and they weren't participating. However, they knew the rules of the program and that payment to them would likely be delayed from the govnt. That is no reason to deny a person their car. Given their complete incompetence and thier dishonesty, we told them we would be reporting them to the BBB, Illinois Attorney General Lisa Madigan's office, LEXUS and the CARS Program for fraud, all of which we have done. Dealer turned my car away for service after having spent 7K in Wisconsin for a new short engine block. As soon as I asked for repair documentation on how to diagnose error codes 1349, 0300, 0301, 0303, 0305, they simply refused to service my vehicle, closed out the service order and called it a 'legal document.' Granted, the dealership did not do the original repairs but they know they were performed incorrectly and will not help. More
