McCombs Ford West responded

Hi, Mr. Davis, I think there are a few misunderstandings. While you are right that we insist you fill out some information to a.) prove your identity and b.) check with the Office of Foreign Asset Control for inclusion on restricted lists, it is not optional for the dealership to gather that information. It is required under Section 311 of the USA Patriot act passed post 9/11. Most dealerships comply with the OFAC and Identify requirements by contracting with a third party to run these checks. This is usually a service provided by the dealership's credit, finance, and privacy software. This is to control the dealership's exposure to the liability introduced by failing to run or running improperly, these checks. The fines can be substantial. Even when a customer has outside financing, we will put the minimum required information into the system and the system will perform a check. Because this check passes through credit reporting agencies, it will show up in the inquiries section of the CRA used. If you have purchased any vehicles since 2002, I will bet that, whether you were aware of it or not, this was handled in exactly the same fashion. However, the fact that this shows as an inquiry should not concern you or any customer. The reason for that is, because of new rules implemented a few years ago, the CRAs no longer penalize consumers for shopping for the best rate when shopping for certain kinds of purchases (cars being one but also mortgages and apartment leasing). When you have a credit check run by a lender or dealership, any subsequent inquiries that are for the purpose of purchasing this automobile will not count as additional inquiries. You have a 14-45 day window (the time is different depending on the CRA) without incurring any score penalty. So once your bank ran your credit, we could have run your credit all we wanted and it would not have affected your score in the slightest. Lastly, We do not sell any customer information to third parties. You should be aware of this because you would have signed a privacy notice that disclosed all of this. That notice is required by law and completely spells out exactly what we do with any customer data that we gather over the course of the transaction. If you require us to mail you a copy of that notice, we will be happy to do that. Again, it is absolutely false to imply that we sell customer information to anyone. I hope that clears everything up. If this was not communicated satisfactorily at the time of your purchase, I sincerely apologize. It was not our intention to confuse or set expectations incorrectly.

I bought the Truck! I found McCombs Ford through the internet over 3 years ago due to local friends in Las Vegas telling me if I wanted a new truck to buy it in Texas! We I found McCombs Ford through the internet over 3 years ago due to local friends in Las Vegas telling me if I wanted a new truck to buy it in Texas! Well, ford wasn't the only dealer there I heard from, but thanks to the deal not being made locally, I flew to San Antonio July 2018 with my best friend who helped me make the drive back to Vegas in my new truck. Not only did my credit get approved quickly, my local credit union claimed they could not! Looks like I may be finding a new bank too! These guys and gals have answered many questions before I got there and several since getting home. If I ever buy a new truck again, I will be visiting their site to see what they can do for me! Even the New Cars Director Jamey got involved to help me make this happen! More
