We were sorry to inform you that we were unable to perform the needed repairs to your vehicle at this time. As previously discussed with you, upon inspection of the engine to determine failure it was found that there was a large amount of sludge in the crankcase, camshaft covers and oil filter housing. As we would like to perform the necessary repairs needed, it has been determined by the factory [Mercedes-Benz USA] that the engine failure is due to lack of maintenance and has declined coverage of any kind. We understand that this is an unfortunate situation and look forward to a resolution to this issue in the near future. Joe, I have read the manufacture warranty and researched the laws related. "Magnuson–Moss Warranty Act" I assume you are familiar... I am not required by law to have the service of the vehicle completed by the manufacture of a dealer of said manufacture. I have informed Mercedes Benz that I have proof of receipt of my most recent oil change and she said that would not be necessary, yet I have not heard from anyone regarding this repair. I will continue to post this everywhere possible about my experience until this is resolved.

Joe, I had re-read your response and there is a discrepancy in what I am hearing from Mercedes-Benz USA and your response. Monday when I called my MB Corp "claims person" she told me know she has no update as they are waiting on the dealer. Now you "the dealer" is telling me you are waiting on Mercedes Benz USA.... See the disconnect?

Joe, I have been told the warranty is not being honored because we failed to maintain the car's service. That is not correct. What is correct is that I did not and have never used MB Dealers to service any of my MB's over the last 10+ years. I offered receipt of last service to MB and was told they don't need it and will not look at it or call the service center as I requested.
