We are disappointed that this customer has posted this review to smear and disparage FMS great reputation. Given the aforementioned review FMS feels compelled to provide readers with the complete and accurate statement of facts. -RJ Foley On February 16th, Joseph Pacella Esq visited to Foley Motorsports to purchase a pre-owned Mercedes-Benz Sport Utility. At this time he was informed that the vehicle had to go to Wagner Mercedes-Benz to be serviced under the manufacture warranty coverage before he could take delivery of it. When the vehicle was a the Mercedes-Benz dealer it was involved a parking lot accident by an employee at the dealership. At this point Foley Motorsports was contacted by Wagner and immediately contacted Joseph Pacella Esq and informed him of the accident and provided him with detailed description and pictures of the damage with an estimate/appraisal of the repair order. At this time Joseph Pacella Esq was offered a complete and total refund of the purchase price. After looking at he appraisal provided to him, he chose to go forward with the sale. In this initial conversation Joseph Pacella Esq was informed by RJ Foley that the work would be done at the Wagner Mercedes-Benz Certified Repair facility and a loaner vehicle would be provided to him. Mr Foley and Joseph Pacella Esq agreed that Joseph Pacella Esq would take the vehicle to a dealer/repair/body shop of his choosing to have it independently inspected prior to completing the sale after the repairs were complete. At every point in this process Foley Motorsports was completely transparent and forthcoming with Joseph Pacella Esq. about the vehicle. On the date the vehicle was ready to be delivered, Joseph Pacella Esq was contacted by Foley Motorsports to find out where the vehicle needed to by delivered for the independent inspection that was agreed upon to complete the sale. At this point Joseph Pacella Esq demanded that the vehicle be registered and dropped of in his driveway in Longmeadow, MA and the loaner vehicle picked up. At this point Mr Foley called Joseph Pacella Esq and informed him that this was not the agreement and Joseph Pacella Esq hung up the phone on Mr Foley. After calling and being hung up on again, Mr Foley called Joseph Pacella Esq back again and informed him that he decided not to sell him the vehicle and that his money and trade title would be returned to him via Fed Ex and Foley Motorsports would retrieve the loaner vehicle from Joseph Pacella Esq. the following day. At this time Joseph Pacella Esq threatened Mr Foley that if this occurred that he would have the vehicle towed and he would charge Foley Motorsports $500 a day for storage. The following day Foley Motorsports went to Joseph Pacella Esq residence in Logmeadow and with the assistance and supervision of the Longmeadow Police Department the loaner vehicle was retrieved from Joseph Pacella Esq. Thank You to the Longmeadow officers that assisted Foley Motorsports with the retrieval without incident...

The 2011 Jeep Wrangler was under agreement and the deposit should not have been taken. It was an unfortunate situation that we regret happening.
