Hi John. We appreciate your honest feedback and would like to clarify a few things about this situation. Your family had no issues filling out the online credit application. When you came to the dealership, you opted not to sign the mandatory privacy notice required by the Gramm-Leach-Bliley Act, which states how automotive dealerships, like banks, treat a customer's private (non-public) information. If you want to reconsider your decision, we will be happy to do business with you. Thank you, Sandra Pomeraning - Customer Relations Manager - (513) 385-1800 ext. 8240

I did not sign the disclosure for the loan app. TFS still approved the loan with zero down. The disclosure form the salesman presented was not one the dealership needed for my file; and should have listed the lending institutions I am giving permission to view my info. Rather, the paper I was given expressly gave permission to all third parties now and in the future including non banking entities. If I am mistaken, then why didn't a sales manager politely explain it to me? I was ignored. I believe I have the right to opt out of a non banking disclosure. Also, the dealership credit app allowed me to go to the next page without signing!!! Got the loan and kept my privacy. Shame on the sales manager and Joseph's credit app algorithm. Also, I anonymously reopened the store credit app when I got home. The disclosure form was now unavailable. Did my salesperson slip this general disclosure into my app as a way to get a customer to sign and add to dealer profit as personal info is sold? Just bought a new car with another dealer. Thank you for the follow up.

Financial institutions covered by the Gramm-Leach-Bliley Act must tell their customers about their information-sharing practices and explain to customers their right to "opt out" if they don't want their information shared with certain third parties. Is your company following the requirements of the Privacy Rule?

do car dealers profit from customer private information sharing if given written permission to do so Yes, car dealerships can legally monetize or benefit from sharing customer information if proper written consent or authorization is granted, though direct cash payouts for individual lists are rare. [1] (https://old.scalirasmussen.com/news/2016/06/16/dealership-buy-sell-transactions-and-customer-privacy)How Dealerships Profit from Data SharingIndirect Financial Gain: Rather than selling a single customer's phone number or social security number for cash, dealerships often partner with third-party vendors, insurance providers, or aftermarket product sellers (like extended warranty or accessory companies). They receive marketing co-op funds, referral fees, or commissions for each customer who signs up for these services. [1] (https://www.cars.com/articles/how-to-keep-your-car-from-sharing-your-sensitive-data-behind-your-back-483328/)Manufacturer Incentives (OEM Agreements): Dealerships frequently share customer data and driving behavior metrics with Original Equipment Manufacturers (OEMs) through data-sharing agreements. In return, the dealership receives manufacturer incentives, software access, and operational benefits. [1] (https://bsm-law.com/oem-data-sharing-agreements-what-dealers-need-to-know/)Lead Generation Partnerships: With affirmative written consent, a dealership's CRM (Customer Relationship Management) network can route buyer profiles or "buying signals" to affiliated businesses or partner networks, generating internal marketing value or referral compensation. [1] (https://www.reddit.com/r/askcarsales/comments/lbah3x/can_dealerships_share_my_personal_info_with_other/)The Legal Framework (GLBA)Financial Institution Status: Because auto dealers routinely arrange financing or leases, the Federal Trade Commission (FTC) classifies them as financial institutions under the Gramm-Leach-Bliley Act (GLBA). [1] (https://www.totaldealercompliance.com/gramm-leach-bliley-act-privacy-rule.html)The Privacy Rule: Under GLBA regulations, dealers must provide a clear privacy notice explaining how nonpublic personal information (NPI) is handled and give consumers the right to opt out. [1] (https://gwcwarranty.com/resource-hub/dealer-compliance-what-every-dealer-needs-to-know/)The Power of Written Consent: General privacy rules restrict sharing NPI with outside third parties unless an opt-out choice is provided. However, obtaining explicit affirmative written permission overrides standard opt-out restrictions, allowing the dealership to transfer or leverage that data without facing regulatory penalties. Furthermore, this is no way to treat a customer or an employee. My salesman was inexperienced and a victim of management enforcing bad policy, while remaining hidden. This dealership greed kills an employee's attempt to make a living. I was a tier 1 approved customer ready to buy and the poor salesperson lost a commission due to a missing opt out box for the little paragraph no one reads.

Sep 11, 2026 -

John responded

I want to be clear. The mandatory disclosure applies to the big paragraph with lending institutions that comes first on the Joseph Toyota form. The small paragraph below gives the other third parties permission for future marketing. This section requires an opt out box. Thus, a customer may opt out while signing permission for lending institutions for the loan. There was no opt out box on this form to prevent an automatic agreement to give up privacy after the loan. Buyer beware!
