On March 5, 2021 I purchased a 2016 Kia Soul from Toyota of Cleveland at 3560 Village North Blvd. SW McDonald TN 37353. At the time of purchase the vehicle had 112,075 miles. On July 3, 2021 the engine seized in the vehicle, at the time of failure the mileage was 115,050, less than 3,000 mile from when we purchased it. This car was purchased for the use of my son who recently got his first "real" job in 8 hours away in Illinois so I wanted him to have a reliable car as he was moving to out of state. He was planning on coming back to Chattanooga for Independence Day and on his way here on July 3rd the car stalled out, he was able to restart it, it went a short distance, died again and would not restart. We had it towed to the closest Kia Dealership. Their service advisor indicated that the engine had blown due to a failure to perform a recall (PI2002B -PI2002B ECU UPDATE (KSDS-2.0L GDI) which detects vibration due to connecting rod bearing wear and alerts the driver at an early stage of this problem with a continuously blinking MIL and places the vehicle in Limp Home Mode and forces reduced engine RPMs to prevent engine damage/failure. We had previously purchased two new vehicles from Toyota of Cleveland (TOC) and found them to be reputable so I felt comfortable buying from them and trusted that I was getting a reliable vehicle at a fair price. I was further comforted by the fact that TOC provided me a CarFax Vehicle History Report that stated it was a $39.99 document that was provided by TOC free of charge, presumably to inform their potential customers, that among other things, there were no outstanding recalls, which is explicitly stated in this report. Further I was provided with a record of multipoint inspection of the vehicle by TOC which occurred on 12/22/20. Given the fact that the engine failure was due to a connecting rod failure that is a degenerative problem that has an obvious and distinctive vibration signature, it would have been impossible for a properly trained mechanic to miss this source of eminent failure. On July 14th, we interacted with Monte Burney the general manager and his assistant Maggie Renner. We provided them with all of the details of the failure and details about the recall. Mr. Burney assured us that there were no outstanding recalls even after being given the campaign details in writing. He established himself as an authority on the issue by stating explicitly that he would know the status of any recalls because, in his exact words, “we own three Kia dealerships”. I suggested that he call the service advisor at the other Kia dealership who was unequivocal in stating that the recall was active and had been the whole time that the vehicle had been in possession of TOC. Subsequently Mr. Burney changed his story admitting that the recall was active but he made a distinction-without-a-difference that it was a “Warranty Recall” and not a “Safety Recall”. Given the resources available to a company that, according to Mr. Burney, owns three Kia dealerships it would have been impossible with even the most superficial due diligence for TOC to be unaware of this issue and even if somehow they managed to fail to find information it would have been impossible to miss the pending failure during a mechanics inspection of the vehicle. If they would have done their duty, the issue would have been resolved (at Kia’s expense), the drivetrain warranty on the vehicle would have been extended to 150,000 miles and had the engine failure still occurred before 150,000 miles, Kia would have replaced the engine at no cost to me (or TOC). We have made every conceivable attempt to negotiate a fair settlement with Toyota of Cleveland and their response has been total stonewalling with their only offer being to do absolutely nothing to resolve the situation. Given that and the details above, we were forced to sue due to the fact that we believe Toyota of Cleveland is guilty of: • Breach of Contract • Inadequate Disclosure • Fraudulent Misrepresentation • Negligent Misrepresentation • Violation of the Tennessee Consumer Protection Act We Provided the following Documents in support of this claim: 1. Bill of Sale 2. Buyers Order 3. Odometer Disclosure 4. TOC Provided - CarFax Vehicle History Report 5. TOC Provided – Record of Dealer Vehicle Record of Multipoint Inspection and Remedial Repair 6. Correspondence with service advisor Brittney Barr at Wyatt Johnson Kia 7. Recall (PI2002B -PI2002B ECU UPDATE (KSDS-2.0L GDI) At this time we will have to wait to see how the court sees this issue but in talking with several attorneys it seems like an open and shut case of fraud in our favor. Save yourself a lot of money and deal with a reputable dealership that does not victimize their consumers and then fail to do anything to help. More
